An ORL resolution on loss of PWZ may affect a foreign doctor’s ability to work immediately. The first step is not to copy a general appeal from the internet. The document must be classified by its wording, legal basis and practical effect.

Loss, withdrawal, expiry, removal from the register and a change of registered data are not necessarily the same legal act. The available remedy, deadline and possibility of interim protection depend on what the regional medical council actually decided.

Some ORL resolutions are subject to an appeal to NRL. Other forms of interference may require a different route. If NRL later declares the appeal inadmissible, it may be necessary to challenge both the NRL procedural decision and the ORL act separately.

The pleading should identify the precise act, explain why the chosen remedy is available and set out allegations connected with that act. A mistaken route may consume valuable time even where the doctor has strong substantive arguments.

Interim protection and the ability to continue working

An appeal or court complaint does not always suspend the practical effect of the act. The doctor should establish whether the resolution is enforceable, what appears in the register and whether a separate request for suspension or interim protection is available.

A request should describe concrete consequences for professional work, patients, contracts and the medical entity. It must still remain proportionate and tied to the legal conditions for protection.
