The WSA complaint deadline in a Polish medical licensing case is usually 30 days. First, however, you must identify the legal nature of the medical council’s act. Time may run from formal service or from learning about another act. The date printed on the resolution is therefore not enough.
Law checked on 21 September 2026. PWZ means the right to practise medicine. ORL is the regional medical council, NRL is the Supreme Medical Council, and WSA is the voivodeship administrative court.
What starts the WSA complaint deadline?
Article 53 § 1 of the Law on Proceedings before Administrative Courts sets a 30-day period from service of the ruling on the complainant. Before filing, check whether an administrative remedy was available. As a rule, available remedies must be exhausted before a court complaint.
Article 53 § 2 provides a different rule for another act or action covered by Article 3 § 2 point 4. Where the law provides no remedy, the 30 days run from learning that the act was issued or the action taken. Consequently, waiting for formal service is not always safe.
The classification of a PWZ resolution may itself be disputed. Keep evidence of both formal service and any earlier notice of the act. The correct deadline follows from the applicable legal route, not simply the document’s title.
How do you count 30 days?
Exclude the day of the event that starts the period. Day one is the following day. Saturdays, Sundays and public holidays within the period still count.
If the last day falls on a Saturday or statutory public holiday, the deadline moves to the next day that is neither. This follows from Article 83 § 2.
- Service on 2 September 2026: day one is 3 September and day 30 is 2 October.
- Service on 4 September 2026: day 30 falls on Sunday, 4 October. The deadline therefore moves to 5 October.
These examples assume valid service and the application of Article 53 § 1. They do not determine the legal classification of a particular resolution. Also, 30 days is not necessarily one calendar month.
Service, postal notices and electronic records
Check the receipt, envelope and identity of the recipient. If a representative was appointed, establish on whom the document was validly served. A later email forwarding a scan to the client does not necessarily start a new period.
Leaving a letter uncollected does not guarantee that time will stop. Substitute service may take effect even without actual collection. You therefore need evidence of postal notices and compliance with the statutory conditions.
For electronic service, retain the official evidence and the full delivery history. An SMS or email alert alone does not establish the legally effective date. Also distinguish the authority’s service of its ruling from the rules for lodging a court complaint.
Does writing to NRL stop the WSA complaint deadline?
Do not assume that it does. If the administrative appeal is inadmissible, waiting for NRL’s response may create a risk of a late complaint against the ORL act. Each ruling requires a separate review of the remedy and its starting date.
Some cases require two complaints concerning ORL and NRL. Assess that issue before the earliest possible deadline, rather than waiting for all correspondence to end.
Where should the complaint be filed?
Address the complaint to the competent WSA and file it through the authority whose action you challenge. Keep proof of submission or posting by a method that the statute treats as filing. Handing the document to any courier does not automatically have that effect.
Article 53 § 4 also preserves the deadline where the party files directly with an administrative court before it expires. Nevertheless, the usual route is through the authority. Ordinary email does not replace a properly filed electronic procedural document.
What if the deadline has passed?
Reinstatement requires the party to have missed the deadline without fault. As a rule, apply within seven days after the obstacle ends. At the same time, perform the omitted step by filing the complaint. An application concerning the complaint deadline goes through the relevant authority.
You must substantiate the circumstances indicating absence of fault. Lack of legal knowledge or waiting for a convenient appointment does not guarantee relief. Article 53 § 2 also has a specific rule for a late complaint against another act, so the correct legal basis matters.
