An objection to a Polish payment order must be prepared promptly. A payment order may be issued without a hearing on the basis of the claimant’s statement and documents. If the defendant does not react within the applicable time, the order may become enforceable.

A foreign business should first verify who received the documents, when service occurred and which court or electronic system issued the order. Translation, internal circulation or negotiations with the claimant do not automatically stop the procedural deadline.

First steps after receiving a Polish payment order

Preserve the envelope, electronic notification and all attachments. Identify the court, case number, parties, amount, interest, costs and instruction on remedies. The form of the remedy depends on the type of proceedings and order.

The defendant should also check whether the correspondence was served at the correct registered address and whether an authorised person received it. Service issues can be important, but they should not be used as a reason to ignore the order.

  • record the exact service date and method;
  • send the complete order, claim and attachments for review;
  • collect the contract, amendments, invoices and performance records;
  • identify payments, set-off, complaints and termination notices;
  • inform the lawyer about any enforcement or bank-account seizure.

What an objection to a Polish payment order should contain

The submission should challenge the order to the necessary extent and present the defence in the form required for that procedure. Commercial proceedings may require allegations and evidence to be presented early. A general statement that the claim is disputed is rarely enough.

Possible issues include lack of contract, defective performance, payment, set-off, limitation, incorrect interest, lack of standing, contractual penalties or a different governing law. Only arguments supported by the facts and documents should be raised.

Electronic payment proceedings and ordinary court cases

An order issued in electronic payment proceedings follows a different technical route from an order issued by a local court. The defendant should not assume that the same form, address or filing method applies.

After an effective objection, the dispute may continue in the appropriate court procedure. The parties should be prepared to present their complete contractual and evidential position.

Frequently asked questions

How long is the deadline for an objection?

The exact deadline depends on the order and procedure. Rely on the served document and obtain advice immediately.

Do negotiations suspend the deadline?

Usually not unless a procedural act or court decision has that effect. Continue settlement discussions only while protecting the procedural position.

Can documents be filed in English?

Polish proceedings generally require Polish submissions. Foreign-language evidence may require a translation.
